This article seeks to make a contribution to the existing literature on the South China Sea issue by focusing on the impact of regional institutions on conflict management and resolution as well as the limits these institutions face when seeking to de-escalate disputes.

The asymmetric distribution of power in the Asian maritime region is favoring China, increasing the apprehension of its neighbors that, faced with their evident vulnerability, fear about Beijing's intentions. In this context, the balance of power maintains the status quo and limits China's behavior against other coastal countries. Given the disparity of military and economic power between Southeast Asia and China, this balance can only be achieved with the intervention of an extra-regional power, the United States. The renewed American participation as a guarantor of regional security has created new bonds of strategic dependence for Southeast Asia, which in turn have economies that mainly rely on China. The South China Sea conflict is then posing two dilemmas for the region: China's increasing economic leverage and Washington's reactive and challenging Indo-Pacific policy, which might make a stalemate in the maritime conflict possible.
The disputes involve the islands, reefs, banks, and other features of the South China Sea, including the Spratly Islands , Paracel Islands , Scarborough Shoal , and various boundaries in the Gulf of Tonkin. There are further disputes, such as the waters near the Indonesian Natuna Islands , which many do not regard as part of the South China Sea. China's actions in the South China Sea have been described as part of its " salami slicing " strategy,  and since the United States and other states such as France and the United Kingdom have conducted freedom of navigation operations FONOP in the region. The disputes involve both maritime boundaries and islands. Chinese claims in the South China sea are delineated in part by the nine-dash line. This was originally an "eleven-dashed-line," first indicated by the Kuomintang government of the Republic of China in , for its claims to the South China Sea. The Geneva Accords of ,  which ended the First Indochina War , gave South Vietnam control of the Vietnamese territories south of the 17th Parallel, which included the islands in the Paracels and Spratlys.

This article argues that a change in institutional strategy enables The Association of Southeast Asian Nations ASEAN to manage its great power relations and prevent their abrupt political intrusion into the region by providing the policy options of pursuing institutional balancing, bandwagoning, hedging, or co-option. However, due to constraints created by the existing institutional design it is difficult to make any drastic alteration to the institutional strategy unless a radical change in the regional power configuration occurs. By constructing normative constraints through the diffusion of its own rules, norms, and principles in East Asia, ASEAN attempts to tame the regional great powers politically, shape their behaviour, and ensure regional stability. Here, institutional strategy refers to a collective security policy that RSI Member States pursue under the belief that such a policy can enhance their short- or long-term security.
The source of the South China Seas dispute is traceable to the San Francisco Treaty, which failed to stipulate possession of the Spratly islands when Japan lost its title to them after defeat in the Second World War art. The chain of islets, coral reefs and sea mounts that constitute the Spratly and its northern extension the Paracel islands spread across , square kilometres of the South China Sea, a vast continental shelf that constitutes a potentially rich source of oil and natural gas.
